Right to Disconnect (Australia) 333M-1-2: Respect employees' right to refuse out-of-hours contact from the employer and work-related third parties

An employee may refuse to monitor, read or respond to contact or attempted contact from the employer, or from a third party where it relates to their work, outside their working hours, unless the refusal is unreasonable; each right is a workplace right for the general protections in Part 3-1. For the employer this means out-of-hours contact practices must allow a refusal and must not treat a reasonable refusal as a performance or conduct issue, including where clients, customers or other third parties are the ones making contact.
