Chapter 6: Leases (standard terms, dealings, forfeiture and relief, termination) – Queensland Property Law Act 2023

Queensland Property Law Act 2023 153-162: Forfeiture: notice to remedy breach, copy to designated persons, re-entry and relief

What does 153-162 require?

A lessor may exercise a right of re-entry for breach only after giving the lessee a notice to remedy breach in the approved form that specifies the breach, requires it to be remedied if capable of remedy and requires reasonable compensation if demanded, and only if the lessee fails to comply within a reasonable time (section 153); a copy must go to each designated person for the lease (mortgagees and sublessees as defined) (section 154). Acceptance of rent after the notice is not a waiver (section 155); no notice is needed where the lessee has given up possession (section 156); re-entry is exercised peaceably, by written demand or by court proceedings (section 157); and the lessee or a designated person may apply for relief against forfeiture, with the court's powers in sections 158 to 162. Section 151 prohibits contracting out of the Division.
