Queensland Property Law Act 2023
Chapter 6: Leases (standard terms, dealings, forfeiture and relief, termination) – Queensland Property Law Act 2023

Queensland Property Law Act 2023 140-148: Dealings with leases: transfer of the reversion, consent to assign, effect of assignment, surrender and reconfiguration

What does 140-148 require?

On transfer of the reversion the transferee takes the lessor's rights and obligations and rent may be paid to the former lessor until notice (sections 140, 141). Where a lease requires the lessor's consent to assign, sublease, part with possession, change use or mortgage, consent must not be unreasonably withheld, the lessor must respond within a reasonable time and give reasons for refusal, and may not demand a fee beyond reasonable expenses (section 142). On assignment the assignee is bound by and benefits from the lease, and the assigning lessee is released as section 143 provides unless the lease is a prescribed lease or the parties agree otherwise; sections 144 to 148 deal with subsequent assignments, surrender and merger, reconfiguration, head lease surrender and involuntary transmission.
