A lease of land includes the standard terms in Schedule 1 unless the Act, another Act or the agreement provides otherwise: the lessee pays rent, pays the taxes, rates and assessments apportioned to the premises, maintains and leaves the premises in good repair (fair wear and tear excepted), has rent abated if the premises are destroyed or damaged, needs consent to assign, must not commit noxious or offensive acts or waste, has quiet enjoyment, must not change the use without consent, must allow inspection, may be subject to termination for non-payment or breach as clause 11 provides, and must remove the lessee's fixtures (clauses 1 to 12). Section 138 lets a lease for a term of years take effect without entry into possession.
