The organisation and provider agree in advance how a suspected real incident, as opposed to test activity, is recognised and handled: the organisation's incident-response capability and incident definitions are discussed, someone at the target is aware of when testing runs so the response team is not scrambled unnecessarily, and a procedure is set for what happens if the testers find evidence of a prior or third-party compromise. Where illegal material is discovered, the agreed procedure is to notify the proper authorities and then the organisation, and not to take direction from the client on that point.
