Where personal information is processed by electronic means and in a structured and commonly used format, the data subject has the right to obtain from the controller a copy of the data undergoing processing in an electronic or structured format that is commonly used and allows further use by the data subject; the Commission may specify the format, technical standards, modalities and procedures for transfer. The IRR (section 36) gives primacy to the data subject's control over data processed on consent or contract, for commercial purposes or by automated means.
