NSW Fair Trading Act 1987
Parts 4A and 4B: Event ticket resale and gift cards – NSW Fair Trading Act 1987

NSW Fair Trading Act 1987 58G-58J: Ticket resale: no resale above the original cost plus 10 per cent, no contingent supply, no prohibited advertisements

What does 58G-58J require?

The first purchaser of a ticket to an event in New South Wales must not resell it for more than the original acquisition cost (the price paid including booking and transaction fees) plus 10 per cent, and no other person may resell a ticket for an amount the person knows or ought to know exceeds that amount (section 58G, 1,000 penalty units for a corporation, 200 for an individual). A supplier must not make the supply of a ticket contingent on the purchase of other goods or services (section 58H). The owner of an advertising publication (including a resale website) must ensure that no prohibited advertisement is published, that is a resale advertisement that does not state the original acquisition cost, the ticket's location details or that exceeds the permitted price, with the defences in section 58I. Resale restrictions in ticket terms that go beyond the Part are void (section 58J).
