New Zealand Credit Contracts and Consumer Finance Act 2003
Part 1A: Lender responsibilities – New Zealand Credit Contracts and Consumer Finance Act 2003

New Zealand Credit Contracts and Consumer Finance Act 2003 9CA: Keep records of the section 9C inquiries and make them available to the FMA and dispute resolution schemes

What does 9CA require?

The lender must keep records of the inquiries made under section 9C, including their results, in a form that demonstrates how the lender satisfied itself about suitability for the borrower's needs and about repayment without substantial hardship (and the equivalent matters for guarantors and insurance). Those records must be given to the FMA on request, and the records relating to an agreement in dispute must be given to the approved dispute resolution scheme on request.
