A controller may process criminal-offence data for its own purposes to assess a data subject's request for a decision about him or for a service to him (33(2)(a)), or to protect its interests against offences committed against it or its staff, or likely to be, given the facts and circumstances (33(2)(b)). Investigating suspected theft or fraud by staff falls under (b) only with the staff rules of art. 33(3).
