Without prejudice to GDPR art. 10, personal data of a criminal nature (data on criminal convictions, offences, or security measures linked to them) may be processed only insofar as arts 32 and 33 permit. (From 1 September 2026, data on court-imposed bans for unlawful or nuisance behaviour are no longer in the definition, art. 1.) Breaches of GDPR art. 10 or of art. 31 carry an administrative fine of up to EUR 20 million or 4% of worldwide annual turnover (art. 17).
