30-14-2811: duties of controllers toward minors – Montana Consumer Data Privacy Act

Montana Consumer Data Privacy Act 30-14-2811(3)(a): consent of the minor, or of the parent for a child

What does 30-14-2811(3)(a) require?

Before engaging in any activity restricted by 30-14-2811(2), a controller must obtain the minor's consent or, for a child under 13, the consent of a parent or legal guardian; compliance with COPPA's verifiable parental consent requirements satisfies the parental consent requirement. The restrictions on processing and design features do not apply to services used by and under the direction of an educational entity, such as a learning management system.
