Luxembourg Law of 1 August 2018 on Data Protection (GDPR Implementation) L.261-1(4): Labour Code L.261-1(4): allow the CNPD prior-opinion request and do not implement while it suspends the project

What does L.261-1(4) require?

For a planned surveillance processing, the staff delegation, or failing it the employees concerned, may within fifteen days of the prior information ask the CNPD for a prior opinion on whether the project complies; the CNPD must give its opinion within one month of the request (running from a complete file, per its Rules of Procedure of 10 October 2025, Article 37), and the request suspends the project for that period. The employer's rollout plan must therefore leave the fifteen-day window and any suspension before go-live.
