What does L.261-1(3) require?

Where the surveillance processing is carried out for the health and safety of employees, to monitor an employee's output or services where that is the only way to determine the exact salary, or within a flexitime work organisation under the Labour Code, Articles L.211-8, L.414-9 and L.423-1 of the Labour Code apply, unless the processing meets a legal or regulatory obligation.
