ITAR - International Traffic in Arms Regulations 124.3: Export technical data under an agreement only within its scope

What does 124.3 require?

Unclassified technical data may be exported without a licence in furtherance of an approved manufacturing licence or technical assistance agreement if it does not exceed the agreement's scope and limitations; approval is needed for any data beyond them. Classified information may be exported under an approved agreement providing for it if the U.S. party certifies to the DoD transmittal authority that it does not exceed the agreement's limits and complies with the NISPOM (124.3).
