Italy Accessibility Requirements of Products and Services Decree (Legislative Decree No. 82/2022) A13-1: Assessment of substantial modification or disproportionate burden using the Annex V criteria

What does A13-1 require?

The accessibility requirements apply only so far as compliance does not require a substantial modification that changes the basic nature of the product or service, or impose a disproportionate burden on the operator. Operators must assess whether either condition applies, assessing the burden on the Annex V criteria; an operator receiving public or private funding to improve accessibility cannot invoke disproportionate burden.
