Ireland European Union (Accessibility Requirements of Products and Services) Regulations 2023 (S.I. No. 636 of 2023) R15-1: Assessment before relying on fundamental alteration or disproportionate burden, using the Schedule 4 criteria

What does R15-1 require?

An operator may disapply an accessibility requirement only to the extent that meeting it would fundamentally alter the basic nature of the product or service or impose a disproportionate burden, and only after an assessment concluding so; the burden assessment must use the Schedule 4 criteria (ratio of net compliance costs to the operator's overall costs or net turnover, estimated benefits for persons with disabilities, product life and usage). An operator receiving external public or private funding to improve accessibility cannot claim disproportionate burden.
