Without adequacy or safeguards, transfers meeting the other s 78 requirements are allowed only where necessary to protect vital interests, protect legitimate interests of the data subject, prevent an immediate serious threat to public security, for s 45 purposes in individual cases, or for legal claims relating to them, and not where the data subject's fundamental rights outweigh the public interest; such transfers are documented as under s 79(2).
