Without an adequacy decision, transfers meeting s 78 are allowed where a legally binding instrument provides appropriate safeguards or the controller has assessed all circumstances and concluded that appropriate safeguards exist. Transfers on the controller's own assessment are documented (date, time, recipient, reason, data) and provided to the Commissioner on request, and the controller reports them to the Commissioner at least annually (categorised appropriately).
