Before processing in a new filing system, the controller consults the Commissioner where the impact assessment shows substantial risk without mitigating measures or the type of processing, especially with new technologies, mechanisms or procedures, involves substantial risk; the Commissioner may list such operations. The consultation includes the impact assessment, allocation of responsibilities, purposes and means, safeguards and the officer's contact details, plus further information on request. The Commissioner may give written advice within six weeks (extendable by a month for complex cases, notified within a month); urgent processing may start once consultation has begun, with recommendations applied afterwards.
