Germany Accessibility Strengthening Act (BFSG) S17: Disproportionate burden: Annex 4 assessment, renewal for services, funding bar and notification

What does S17 require?

The requirements apply only so far as they do not impose a disproportionate burden on the operator assessed under the Annex 4 criteria. The operator documents the assessment and keeps it for five years, supplying a copy on request (microenterprises dealing with products give only the relevant facts on request). A service provider relying on it must repeat the assessment for each category or type of service at least every five years and whenever the service changes or the competent authority asks. An operator receiving third-party public or private funds to improve accessibility cannot rely on it, and an operator relying on it must inform the competent authority of the Member State concerned without delay (not microenterprises).
