Germany Accessibility Strengthening Act (BFSG) S16: Fundamental alteration: assess, document for five years, provide on request and notify

What does S16 require?

The ordinance requirements apply only so far as meeting them does not require a significant change that would fundamentally alter the product's or service's essential characteristics. The operator must assess whether this is the case, document the assessment and keep it for five years from the last making available of the product or last provision of the service, give the authority a copy on request, and inform without delay the German authority and those of the other Member States concerned when relying on it. Microenterprises dealing with products need not document or notify but must give the authority the relevant facts on request.
