FATF 40 Recommendations R.39: Extradition

What does R.39 require?

Countries execute extradition requests for money laundering and terrorist financing constructively, effectively and without undue delay and do not provide safe havens for those charged with financing terrorism, terrorist acts or terrorist organisations: making the offences extraditable, having clear and efficient processes with prioritisation and a case management system, not imposing unreasonable or unduly restrictive conditions, and having an adequate legal framework; either extraditing their own nationals or, where refusing solely on nationality, submitting the case without undue delay to their own authorities for prosecution as for any serious offence, cooperating on procedure and evidence; treating dual criminality as satisfied where the underlying conduct is criminalised in both countries; providing simplified mechanisms such as direct transmission of provisional arrest requests, extradition on warrants or judgments and consent-based extradition; and resourcing the responsible authorities to high professional standards.
