Countries rapidly, constructively and effectively provide the widest possible range of mutual legal assistance for money laundering, predicate offence and terrorist financing investigations, prosecutions and related proceedings, with an adequate legal basis and treaties or arrangements where appropriate: not prohibiting or unduly restricting assistance; having clear, efficient processes for prioritising and executing requests through a central authority with a case management system; not refusing on the sole ground that the offence involves fiscal matters or on grounds of institutional secrecy except where legal professional privilege applies; keeping requests confidential and telling the requesting country promptly if they cannot; rendering assistance without dual criminality where no coercive action is involved and treating dual criminality as satisfied whenever the underlying conduct is criminalised in both countries; making the production, search, seizure and witness powers of Recommendation 31 and a broad range of other techniques available for foreign requests and, where consistent with domestic law, for direct requests between counterparts; considering mechanisms to determine the best venue for prosecution; sending complete, expeditious requests after ascertaining the requested country's requirements; and resourcing and staffing the central authority to high professional standards.
