EU Anti-Money Laundering Directive (Directive (EU) 2024/1640)
Chapter II, Section 1: Central beneficial ownership registers – EU Anti-Money Laundering Directive (Directive (EU) 2024/1640)

EU Anti-Money Laundering Directive (Directive (EU) 2024/1640) 12-13: Register entities: grant legitimate-interest access by category, verify identity and respond within 12 working days

What does 12-13 require?

Persons with a legitimate interest in preventing and combating money laundering, its predicate offences and terrorist financing get access, without the entity being alerted, to the beneficial owner's name, month and year of birth, country of residence and nationality, and the nature and extent of the interest (journalists, civil society and academia, and certain third-country counterparts also see historical information and a description of the ownership structure). Deemed categories include media, civil society, prospective transaction counterparties, third-country obliged entities performing due diligence, third-country authorities, company registration authorities, EU funds and recovery facility authorities, public procurement authorities and AML/CFT product providers serving obliged entities. Register entities verify the legitimate interest from the applicant's function or occupation and (except for media and civil society) the connection with the entity sought, recognise verifications by other Member States' registers, verify the applicant's identity on every access (including through electronic identification), and from 10 November 2026 decide within 12 working days (extendable in surges), granting a three-year access certificate and answering later requests within 7 working days. Refusal is allowed only on the listed grounds.
