A source with Program 2 or 3 processes must comply with the coordination (68.93), emergency response program (68.95) and exercise (68.96) requirements, except that a source whose employees will not respond to accidental releases need not have a 68.95 program provided that: sources with any regulated toxic above threshold are included in the community emergency response plan under EPCRA section 303 (42 U.S.C. 11003); sources with only flammables have coordinated response actions with the local fire department; appropriate mechanisms exist to notify emergency responders when a response is needed, including timely data and best estimates of the nature of the release; the source performs the annual coordination activities of 68.93 and the annual notification exercises of 68.96(a); and it maintains and implements, as necessary, procedures for informing the public and response agencies about releases and partners with them to ensure a community notification system warns the public in the area potentially threatened, documenting the partnership.
