EPA RCRA Hazardous Waste Management 264.147: § 264.147 Liability requirements

The owner or operator of a TSDF (or group of facilities) must demonstrate financial responsibility for bodily injury and property damage to third parties from sudden accidental occurrences of at least $1 million per occurrence and $2 million annual aggregate, exclusive of legal defense costs; owners or operators of surface impoundments, landfills, land treatment facilities or disposal miscellaneous units must also cover nonsudden accidental occurrences of at least $3 million per occurrence and $6 million annual aggregate (the two may be combined). Coverage may be shown by liability insurance with the Hazardous Waste Facility Liability Endorsement or Certificate of Liability Insurance in the prescribed wording, the financial test or a guarantee, a letter of credit, a surety bond, a trust fund, or combinations (a partial financial test may not be combined with a guarantee on consolidated statements); the Regional Administrator must be notified within 30 days when a claim reduces the coverage or a Certification of Valid Claim is entered. Variances and adjustments may be set according to risk. Coverage continues until the Regional Administrator confirms, after the closure certifications, that it is no longer needed. The financial test for liability requires submissions 60 days before first receipt for new facilities and annual updates within 90 days of fiscal year end, with other coverage for the full amount within 90 days if the test is failed.
