Owners or operators of units needing post-closure care must establish post-closure financial assurance with the same menu of mechanisms and conditions as for closure: a post-closure trust fund (with the pay-in period, top-ups within 60 days, releases where the fund exceeds the remaining cost during post-closure care and reimbursement of itemised bills within 60 days); a surety bond guaranteeing payment or performance with a standby trust; an irrevocable letter of credit; post-closure insurance; the financial test with the same criteria and annual updates; or a corporate guarantee; with multiple mechanisms, multi-facility use and the single combined mechanism of 264.146 allowed. Assurance must be in place before a new facility first receives waste for disposal and continues until the Regional Administrator releases it after the post-closure completion certification.
