Ecuador Ley Orgánica de Protección de Datos Personales (LOPDP) 28-29: Arts. 28 and 29 and RGLOPDP Art. 18: credit data and the rights of credit data subjects

Processing to report on solvency or credit behaviour is presumed lawful where the data come from public sources or from the creditor, may be used only for that analysis and may not be disclosed or used for secondary purposes; credit data about economic, financial, banking or commercial obligations may never be communicated once five years have passed since the obligation became due. Credit data subjects may access their information personally and free of charge as often as they wish (on screens provided by credit reference services and in printed reports not usable for credit or commercial purposes), obtain reports showing their history clearly, and require sources to update, rectify or delete unlawful, false, inaccurate, incomplete or expired information, sources deciding within 15 days and credit reference services marking the data as under review meanwhile. The Reglamento assigns regulation and supervision of credit data to the Junta de Politica y Regulacion Financiera y Monetaria and the Superintendencia de Bancos.
