Part 742: CCL-based control policy – EAR - Export Administration Regulations

EAR - Export Administration Regulations 742.15: 742.15 Encryption items (EI)

Encryption items classified under 5A002, 5A004, 5D002.a, .c.1 or .d and 5E002 technology need a licence to all destinations except Canada unless License Exception ENC applies; after classification or self-classification, mass market items become 5A992 or 5D992 and leave this section. Applications are reviewed case by case with other agencies; Encryption Licensing Arrangements (valid four years, sales territory stated, sometimes with pre-shipment notice) may cover unlimited quantities to more sensitive government end users outside E:1 and E:2. Publicly available encryption source code is not subject to the EAR, even under a licensing fee; for such code implementing non-standard cryptography, the internet location or a copy must be sent by email to BIS and the ENC Encryption Request Coordinator, with new copies when cryptographic functionality changes and a new notice when the location changes.
