A licence is required to all destinations, including Australia, Canada and the U.K., for devices primarily useful for surreptitious interception of wire, oral or electronic communications (5A001.f.1, 5A980), related software (5D001.c, 5D980.a), development, production or use software and technology (5D001.a and .b, 5D980.b, 5E001.a, 5E980), alongside 18 U.S.C. 2512; a device is covered if its design makes it primarily useful for surreptitious listening, not merely because it is small. Applications are generally approved only for communication service providers in the normal course of their business or government employees and contractors in the normal course of government activities, and denied to AT-controlled countries; no licence exceptions (740.2) or contract sanctity apply.
