Critical Infrastructure Risk Management Program (CIRMP) Rules 2023 9(2): s 9(2) AusCheck background checks where the CIRMP uses them: criminal history criteria, dual identity verification, notification, Secretary's advice

The suitability process may be an AusCheck background check; where the CIRMP permits one it must assess the information in paragraphs 5(a) to (d) of the AusCheck Act, the criteria are the criminal history criteria (whether the person has a CIRMP criminal record and the nature of the offence) and the identity assessment consists of both an electronic and an in-person identity verification check; the entity must notify the Secretary when a background check is no longer required for a critical worker; and in assessing suitability it must consider any advice from the Secretary under regs 21DA(2)(a), (2)(b), (4) and (5) of the AusCheck Regulations, whether access would be prejudicial to security, and any other information affecting suitability. Baseline entities are not required to use AusCheck.
