A lawyer must not knowingly give a tribunal a false account of fact or law or leave an earlier false statement of material fact or law uncorrected, must disclose directly adverse controlling authority the other side has not cited, and must not put forward evidence known to be false; where material evidence offered by the lawyer, the client or the lawyer's witness turns out to be false, reasonable remedial steps follow, up to disclosure to the tribunal. The same remedial duty arises on knowing that someone is about to engage, is engaging or has engaged in criminal or fraudulent conduct connected with the proceeding. These duties run at least until the proceeding ends and prevail over Rule 1.6. In an ex parte application every material fact known to the lawyer, favourable or not, must be laid before the tribunal. Connecticut adds that juror discussion or conduct contrary to the court's instructions, learned of before judgment, must be reported to the trial judge without delay.
