Client-lawyer relationship (Rules 1.1 to 1.18) – Connecticut Rules of Professional Conduct (Connecticut Practice Book)

Connecticut Rules of Professional Conduct (Connecticut Practice Book) 1.8-h-k: No prospective malpractice limits, no settling liability with unadvised clients, no proprietary interest in the cause, no sexual relations, and imputation

What does 1.8-h-k require?

A lawyer may not agree in advance to cap malpractice liability unless the client has independent counsel for that agreement, and may not settle an actual or potential malpractice claim with a client or former client who is unrepresented unless that person has been told in writing to consider independent advice and given a fair chance to get it. No proprietary stake may be taken in the cause of action or the subject of litigation the lawyer is running, apart from a lien the law grants for fees and expenses and a reasonable contingent fee in a civil case. Sexual relations with a client are barred unless a consensual relationship existed before the client-lawyer relationship began. Every prohibition in subsections (a) to (i) that applies to one lawyer in a firm applies to all of them.
