Connecticut Rules of Professional Conduct (Connecticut Practice Book) 1.10: Imputation of conflicts within a firm and the screening exception for lateral lawyers

What does 1.10 require?

While lawyers practise together in a firm, none of them may knowingly take on a client that any one of them would have to refuse under Rule 1.7 or 1.9, with two exceptions: where the disqualification rests on the individual lawyer's personal interest and poses no significant risk to the other lawyers' representation, and where it arises from a lateral lawyer's work at a previous firm and that lawyer is promptly walled off and shares no part of the fee, the affected former client is promptly sent written notice describing the screen, affirming compliance by the firm and the screened lawyer, noting that a tribunal may review the arrangement and undertaking prompt responses to enquiries, and the screened lawyer and a partner certify compliance on reasonable request and when the screen ends. A firm is not barred from acting against a departed lawyer's former client unless the matter is the same or substantially related and a remaining lawyer holds material protected information. Affected clients may waive under Rule 1.7; government lawyers are governed by Rule 1.11.
