A data holder must meet the external dispute resolution requirements for each designated sector in which it operates (civil penalty): AFCA membership for banking and non-bank lending (clause 5.2 of Schedule 3); for energy, energy and water ombudsman membership, or AFCA membership, or both, depending on whether the person is a retailer, an accredited person or both (clause 5.2 of Schedule 4).
