Competition and Consumer (Consumer Data Right) Rules 2020 1.10C: Rule 1.10C: confirm trusted adviser status and never make the nomination a condition of supply

An accredited person or CDR representative may invite a consumer to nominate trusted advisers, who must belong to one of the listed classes: qualified accountants, practising lawyers, registered tax agents, BAS agents and tax (financial) advisers, financial counselling agencies, relevant providers under the Corporations Act (other than provisional relevant providers and limited-service time-sharing advisers), and mortgage brokers. Where it has taken reasonable steps to confirm that a nominee was and remains a member of a class, the nominee is treated as a member. It must not make nominating a trusted adviser, nominating a particular person, or giving a TA disclosure consent a condition of supplying the requested goods or services; where the only service requested is collection and provision of the data to a trusted adviser, the nomination and the TA disclosure consent (but not the choice of a particular adviser) may be required.
