Taking and holding the deposit – California Civil Code Section 1950.5 (Residential Security Deposits)

California Civil Code Section 1950.5 (Residential Security Deposits) c-4: (c)(4) Higher security from a service member: written statement and return after six months

From 1 April 2025, where a landlord or agent charges a service member (Military and Veterans Code section 400) who will live in the property more than its standard or advertised security because of credit history, credit score, housing history or a similar factor, the landlord gives the tenant, on or before signing the lease, a written statement of the higher amount and why it is charged. The extra amount is returned after no more than six months of residency if the tenant has not fallen behind with rent, and the return date is written into the lease.
