Unless a listed exception applies, a provider must not pay an education agent commission for recruiting an overseas student who has already started a course with another registered provider. Commission may still be paid for students who became accepted students on or before 31 March 2026, for the courses named in the CoEs for which the visa was granted, or for a course that starts after the student finishes the principal course with the other provider. These provisions were inserted by Amendment Instrument F2026L00033 from 21 January 2026.
