A provider must have a written agreement with each education agent that formally represents it and keep the agent's details in PRISMS. The agreement must state the provider's responsibility for ESOS compliance at all times, what the agent must do under Standard 4.3, how the provider monitors the agent and checks the information it gives students, the corrective action available, grounds for termination, and when information about the agent may be disclosed to the provider and government agencies.
