Chapters 4 to 6: Offences, enforcement and remedies – Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2)

Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2) s267-270: ss 267 to 270 Remedy consumer guarantee failures for services, and refund on termination

When services supplied to a consumer fail a consumer guarantee (other than failures caused solely by a third party's act or representation or by an independent cause after supply, except for due care and skill), the supplier must remedy a failure that is not major within a reasonable time on request; if it refuses or delays, the consumer may have it remedied elsewhere and recover reasonable costs or terminate. For a major failure (services a reasonable consumer would not have acquired knowing the failure, substantial unfitness or failure to achieve the made-known purpose or result not easily remedied, an unsafe situation, or several failures together; s 268) the consumer may terminate or claim compensation for reduced value, plus reasonably foreseeable loss. On termination the supplier must refund money and other consideration for the unconsumed services (s 269) and refund connected goods, collecting them at its expense if they cannot be returned without significant cost (s 270).
