Where relevant money or relevant property is lost (deficiency, destruction and damage count as loss), the Minister or non-corporate entity official who had custody of it at the time owes the Commonwealth an amount if they failed to take the steps a reasonable person would have taken in the circumstances to prevent the loss. Custody of money means holding it as a petty cash advance, change float or other advance, or having received it without yet banking or dealing with it under section 55; custody of property means having taken delivery, not having returned it to someone entitled to receive it for the Commonwealth, and having signed on delivery an acknowledgement that strict care would be taken of it at all times. The amount owed is the money lost or, for property, its value or the repair cost if lower.
