An employee who, because of disability, cannot perform the full range of duties at the required competence and meets the disability support pension impairment criteria may be paid a percentage (10% to 90%) of the relevant minimum wage equal to their assessed capacity, subject to the minimum weekly amount in clause I.4.2 of the current award (consolidated to 16 September 2026, read 30 September 2026). Capacity must be assessed by an approved assessor after consulting the employer, the employee and, if the employee wishes, a union; the assessment is recorded in an SWS wage assessment agreement signed by both, kept among time and wages records and lodged with the Fair Work Commission (a union not party may object within 10 working days). Reviews occur yearly or on reasonable request. The employer must take reasonable steps to adapt the workplace. A trial of up to 12 weeks (plus up to 4 weeks' adjustment) may be used, paid at least the clause I.10.3 minimum. Employees with workers compensation or rehabilitation claims against the employer are excluded; other conditions apply pro rata.
