From 12 September 2026 the Commissioner may summon a person believed capable of giving information, evidence, documents or answers relevant to compliance with s 63D, 63DA(1) or 63DB(1) to attend before the Commissioner or a named delegate, and may require documents to be made available for inspection and copying. The examination is on oath or affirmation, in private, with an adviser present; a record is made and a copy given on request; the person has a High Court witness's protection. Failing to comply with the summons, to answer a required question or to take the oath or affirmation is an offence (12 months imprisonment) and a civil contravention (1,000 penalty units); failing the summons or a question is excused for a journalist whose compliance would tend to disclose a confidential source. Self-incrimination is no excuse, but an individual's answers are inadmissible against them except in proceedings for these contraventions or Criminal Code proceedings for false or misleading information or documents or for obstruction.
