Part 4A: Social media minimum age – Australia Online Safety Act 2021

Australia Online Safety Act 2021 s63C: Determine whether the service is an age-restricted social media platform

A service is an age-restricted social media platform if its sole or a significant purpose is online social interaction between two or more end-users (including sharing material for social purposes, disregarding advertising and advertising revenue), it lets end-users link to or interact with others and post material, and it meets any conditions in the legislative rules; or if it is specified in the rules. Rule 4A (inserted from 26 March 2026) adds the condition that the service has a recommender feature (selects material using information associated with the account and displays it) or a logged-in feature (an endless feed, feedback on others' engagement, or time-limited material, at least one of which is available only when using an account). Excluded: services with no material accessible to end-users in Australia, and the rule 5 classes whose sole or primary purpose is messaging, email, voice or video calling, online games, sharing information about products or services, professional networking or development, education or health, and services with a significant purpose of communication between educational institutions and students or families, or between health care providers and their patients.
