Australia Online Safety Act 2021
Part 9: Online content scheme, industry codes and standards – Australia Online Safety Act 2021

Australia Online Safety Act 2021 s145-147: Comply with industry standards determined by the Commissioner

What does s145-147 require?

Where a requested code is not developed, is inadequate, misses its indicative targets or is refused, where no body represents a section, or where a code registered for at least 180 days is deficient and not fixed within a notified period, the Commissioner may determine an industry standard by legislative instrument after at least 30 days of public consultation. Industry standards prevail over inconsistent codes (s 150). Standards in force include the Online Safety (Relevant Electronic Services, Class 1A and Class 1B Material) Industry Standard 2024 and the Online Safety (Designated Internet Services, Class 1A and Class 1B Material) Industry Standard 2024. A participant in the section must comply: 30,000 penalty units, with each day of a continuing contravention not treated separately; formal warnings (s 147).
