Part 9: Online content scheme, industry codes and standards – Australia Online Safety Act 2021

Australia Online Safety Act 2021 s137-144: Comply with the registered industry codes that apply to the provider's section of the online industry

What does s137-144 require?

Bodies representing the eight sections of the online industry (social media services, relevant electronic services, designated internet services, search engines, app distribution services, hosting services, internet carriage services, and equipment manufacturers, suppliers, maintainers and installers) develop industry codes the Commissioner registers after public and industry consultation of at least 30 days each; a code that deals with complaints about class 1 or class 2 material must provide for referral of dissatisfied complainants to the Commissioner (s 139). Registered codes include the Consolidated Industry Codes of Practice for the Online Industry (Class 1A and Class 1B Material) and the Age-Restricted Material Codes registered on 27 June and 9 September 2025. Where the Commissioner is satisfied a participant has contravened an applicable registered code, it may direct the participant to comply, and the direction must be followed: 30,000 penalty units, with each day of a continuing contravention not treated separately; formal warnings for code breaches (s 144); complaints about code breaches under s 40.
