A person who is or was an executive officer or high managerial agent of a training organisation or former RTO and possesses or controls its VET student records gives a copy to ASQA within 30 days after the organisation's registration is cancelled or lapses (where no transfer under s 213 has been arranged) or after it effectively ceases to operate, in the electronic form and to the information technology requirements ASQA specifies by legislative instrument (unless waived): offence of 750 penalty units, civil penalty of 1,500.
