Australia National Consumer Credit Protection Act 2009 (Cth) ncc-s72-73: National Credit Code ss 72 and 73 Respond to hardship notices in time and confirm agreed changes

When a debtor gives a hardship notice, orally or in writing, the credit provider may ask for relevant information within 21 days and must, within the period the s 72(5) table sets, give written notice either recording the agreed change or stating that no change was agreed, the reasons and the AFCA contact details and rights (not needed for a deferral or reduction of up to 90 days). A change agreed for hardship must be confirmed to the debtor and any guarantor in writing within 30 days (s 73).
