Australia Hospitality Industry (General) Award 2020 (MA000009) 41: Clause 41: employee notice, limited deductions, payment instead of working notice, and job search time

Employer notice is set by the NES. Employees (other than those excluded) must give notice by length of service (1 to 4 weeks, Table 17); if an employee aged 18 or over gives short notice, the employer may deduct no more than one week's wages, only if it did not agree to shorter notice and the deduction is reasonable. If an employee gives proper notice, the employer may pay instead of having them work all or part of it, paying what s 117 would require had the employer terminated. Where the employer gives notice, the employee must be allowed up to one day off without loss of pay to seek work.
