A workplace delegate who has given written notice may represent eligible workers in consultation, roster changes, disputes, discipline, bargaining and other processes and communicate with them during work, breaks or before or after work. The employer must provide a private fit-for-purpose room or area, a noticeboard, the usual electronic communication including Wi-Fi, secure storage and office equipment (unless absent, impractical at the time or unobtainable after reasonable steps) and, unless a small business employer, up to 5 days' paid initial training and at least one day each later year (one delegate per 50 eligible workers a year from 1 July), on 5 weeks' notice, approving at least 2 weeks before and not unreasonably withholding. It must not unreasonably refuse to deal with, mislead or obstruct a delegate (s 350A).
